1. Acceptance of Terms

By accessing and using Avahana's website and services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

Avahana provides a cloud workspace platform that enables developers to deploy and manage applications with one-click deployments. Our services include:
Cloud workspace management
Application deployment tools
Developer tools and integrations
Documentation and support resources

To access certain features of our service, you may be required to register for an account. When you register, you agree to:
Provide accurate, current, and complete information
Maintain and promptly update your account information
Maintain the security of your password
Accept all responsibility for activities that occur under your account
Notify us immediately of any unauthorized use of your account

You agree not to use the service:
For any unlawful purpose or to solicit others to perform unlawful acts
To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
To infringe upon or violate our intellectual property rights or the intellectual property rights of others
To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
To submit false or misleading information
To upload or transmit viruses or any other type of malicious code
To collect or track the personal information of others
To spam, phish, pharm, pretext, spider, crawl, or scrape
For any obscene or immoral purpose
To interfere with or circumvent the security features of the service

The service and its original content, features, and functionality are and will remain the exclusive property of Avahana and its licensors. The service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

You retain ownership of any content you submit, post, or display on or through the service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute such content for the purpose of operating and promoting our service.
You are responsible for your User Content and represent that you have all necessary rights to grant us the license described above.

You may not use our service:
In any way that violates any applicable national or international law or regulation
To transmit, or procure the sending of, any advertising or promotional material without our prior written consent
To impersonate or attempt to impersonate the company, a company employee, another user, or any other person or entity
In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful

We reserve the right to withdraw or amend our service, and any service or material we provide, in our sole discretion without notice. We will not be liable if, for any reason, all or any part of the service is unavailable at any time or for any period.

We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the service will immediately cease. If you wish to terminate your account, you may simply discontinue using the service.

The service is provided on an "as is" and "as available" basis. We make no warranties, expressed or implied, and hereby disclaim and negate all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

In no event shall Avahana, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the service.

You agree to defend, indemnify, and hold harmless Avahana and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees).

These Terms shall be interpreted and governed by the laws of India, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.
By continuing to access or use our service after any revisions become effective, you agree to be bound by the revised terms.
